Age Verification Policy

INTRODUCTION

This Age Verification Policy explains how Fanvue implements age verification requirements to comply with global regulations and protect minors from accessing adult content. As laws requiring age verification for adult platforms expand worldwide, Fanvue is committed to implementing robust verification systems while respecting user privacy.

This Policy supplements the General Terms & Conditions and other applicable Fanvue Policies. If there is any conflict between this Policy and the General Terms, the terms of this Policy shall prevail for age verification matters.

All defined terms used herein shall have the meaning assigned in the General Terms & Conditions, unless otherwise stated.

DEFINITIONS

“Age Estimation” means the simplified verification process for viewers that confirms a user is over 18 without collecting detailed identity documents.

“Age Verification” means the process of confirming a user meets the minimum age requirement of 18 years through approved verification methods.

“Full KYC” means comprehensive identity verification required for Creative Users, including document verification and identity checks.

“Verification Provider” means third-party services approved by Fanvue to perform age and identity verification (currently Ondato).

“Regulated Jurisdiction” means any country, state, or territory with laws requiring age verification for adult content platforms.

1. AGE VERIFICATION REQUIREMENTS

1.1 Minimum Age Requirement

1. All users of the Platform must be at least 18 years of age.
2. Users in Regulated Jurisdictions must complete age verification before accessing adult content.
3. Fanvue reserves the right to require age verification from any user regardless of location.

1.2 Geographic Requirements

The following jurisdictions currently require age verification for adult content platforms:

1.3 Upcoming Requirements

• Spain: Organic law for protection of minors in digital environments passed; age verification system (Cartera Digital) in development. Full enforcement expected 2026.

2. VERIFICATION PROCESS

2.1 When Verification is Required

1. Users in Regulated Jurisdictions attempting to access adult content will be prompted to verify their age.
2. Location detection is performed based on IP address and other technical indicators.
3. Creative Users must complete Full KYC regardless of location.

2.2 Verification Methods

1. For Viewers (Age Estimation):

   • Simplified age confirmation process
   • No document storage for basic age verification
   • Instant verification through Ondato’s age estimation service

2. For Creative Users (Full KYC):

   • Government-issued ID verification
   • Facial recognition matching
   • Comprehensive identity verification
   • Document data are stored per USC 2257 requirements

2.3 Verification Flow

1. A user encounters age-gated content
2. System checks user location and account status
3. If verification required, user is redirected to secure verification provider
4. User completes appropriate verification process
5. Result is returned to Fanvue and access is granted or denied

3. DATA HANDLING

3.1 Information Collected

1. Age Estimation collects:

   • Basic age confirmation
   • Verification timestamp
   • Pass/fail status

2. Full KYC additionally collects:

   • Government ID details
   • Biometric data for matching
   • Document images (stored securely)

3.2 Data Processing

1. All verification data is processed in accordance with our Privacy Policy.
2. Verification is performed by approved third-party providers under strict data processing agreements.
3. Fanvue stores only the minimum data necessary for compliance.
4. Verification status is indicated by secure tokens, not raw personal data.

3.3 Data Retention

1. Verification status is retained for the duration of your account.
2. Document data for Creative Users is retained per USC 2257 requirements.
3. Failed verification attempts are logged for security purposes.

4. ACCESS RESTRICTIONS

4.1 Pre-Verification Access

1. Users who have not completed required verification can:

   • Browse non-adult content
   • View Creator profiles without explicit content
   • Manage account settings

2. Users cannot:

   • View adult or explicit content
   • Purchase adult content

4.2 Failed Verification

1. Users who fail age verification will be restricted from adult content access.
2. Multiple failed attempts may result in temporary account restrictions.
3. Fanvue reserves the right to terminate accounts that cannot verify age.

4.3 Appeals Process

1. Users who believe their verification was incorrectly rejected may contact support.
2. Appeals must include:
   • Reason for appeal
   • Any relevant documentation
   • Alternative verification methods if applicable

5. COMPLIANCE AND ENFORCEMENT

5.1 Ongoing Monitoring

1. Fanvue regularly reviews and updates verification requirements as laws change.
2. Users may be required to re-verify if:
   • Laws in their jurisdiction change
   • Technical requirements are updated
   • Suspicious activity is detected

5.2 Circumvention Prevention

1. Attempting to bypass age verification is strictly prohibited.
2. Use of VPNs or location spoofing to avoid verification may result in account termination.
3. Sharing accounts to bypass verification violates our Acceptable Use Policy.

5.3 Reporting

1. Users who encounter minors on the platform should immediately report to support@fanvue.com.
2. Fanvue cooperates with law enforcement regarding age verification compliance.

6. CREATOR RESPONSIBILITIES

6.1 Content Labelling

1. Creative Users must accurately label adult content.
2. Mislabelling content to avoid age restrictions is prohibited.
3. Creators found circumventing age verification may face account termination.

6.2 Co-Authored Content

1. Creators must verify the age of all individuals in their content per the Co-Authored Content Policy.
2. Age verification records must be maintained per USC 2257.
