Non-consensual Intimate Image Takedown Policy

Fanvue is committed to the safety and dignity of all individuals. This Policy describes the procedures for submitting and responding to requests for the removal of non-consensual intimate visual depictions in accordance with the Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act (the “TAKE IT DOWN Act”) in the United States, and the Crime and Policing Act 2026 (which amends the Online Safety Act 2023) in the United Kingdom, and applies exclusively to content published on fanvue.com.

This Policy supplements the General Terms & Conditions and other applicable Fanvue Policies. In the event of a conflict between this Policy and the General Terms, the terms of this Policy shall prevail for the subject matter it governs.

All defined terms used herein shall have the meaning assigned in the General Terms & Conditions, unless otherwise stated.


DEFINITIONS

“TAKE IT DOWN Act” means the Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act, signed into law in the United States on 19th May 2025.

“Crime and Policing Act 2026” means the Crime and Policing Act 2026 (UK), which received Royal Assent on 29th April 2026 and which amends the Online Safety Act 2023 to impose duties on user-to-user services to take down NCII within 48 hours of a valid report.

“NCII” means non-consensual intimate visual depiction: any photograph, video, or other visual content depicting an identifiable individual in a sexually explicit manner that was published without that individual’s consent. This includes content falling within the meaning of section 66B of the Sexual Offences Act 2003 for the purposes of UK law.

“Digital Forgery” means any intimate visual depiction of an identifiable individual created or altered through the use of software, machine learning, artificial intelligence, or any other computer-generated or technological means, that a reasonable person would find indistinguishable from an authentic depiction.

“Removal Request” refers to a formal notification submitted by or on behalf of a depicted individual requesting removal of NCII or a Digital Forgery under this Policy.

“Authorised Representative” means a parent, legal guardian, attorney, or other person expressly authorised to act on behalf of a depicted individual.


1. NOTICE AND TAKEDOWN PROCEDURE

  1. Fanvue complies with the notice-and-takedown obligations set out in both the TAKE IT DOWN Act (US) and the Crime and Policing Act 2026 as it amends the Online Safety Act 2023 (UK). Any individual who believes their intimate visual depiction has been published on Fanvue without their consent, whether an authentic image or a Digital Forgery, may submit a Removal Request to have that content removed.
  2. Removal Requests may be submitted by the depicted individual or by an Authorised Representative acting on their behalf.
  3. A valid Removal Request must be submitted by email to takedown@fanvue.com and must include all of the following:
    1. A physical or electronic signature of the depicted individual or their Authorised Representative;
    2. Identification of the content subject to the request, including sufficient information to locate it on the Platform (for example, a URL or description of where the content appears);
    3. A brief statement confirming that the content was published without the consent of the depicted individual;
    4. The full name and contact details (email address) of the depicted individual or, where submitted by an Authorised Representative, of that representative and their relationship to the depicted individual;
    5. Where the request is submitted on behalf of a minor, confirmation of the representative’s authority to act on the minor’s behalf.
  4. Fanvue may remove or disable access to content that is the subject of a valid Removal Request pending review. In appropriate circumstances, we may permanently terminate the accounts of users found to have published NCII or Digital Forgeries without notice.

2. FANVUE RESPONSE TO A VALID REMOVAL REQUEST

  1. Upon receiving a valid Removal Request, Fanvue will, as soon as reasonably practicable and in any event within 48 hours:
    1. Remove or disable access to the identified content;
    2. Take reasonable steps to remove or disable access to copies of that content on the Platform, including content that is the same or substantially the same as the reported content;
    3. Take reasonable steps to prevent the re-upload of the same content.
  2. Fanvue will notify the user responsible for the content that it has been removed, without disclosing the identity or contact details of the person who submitted the Removal Request.
  3. Fanvue reserves the right to remove content at its discretion without prior notice and without liability to the user where the circumstances from which non-consensual publication is apparent.
  4. Users whose content is removed under this Policy may be subject to permanent suspension in accordance with General Terms – Section 16 (Termination).

3. ABUSE AND PENALTIES

  1. Misuse of the Removal Request process, including knowingly submitting false or fraudulent requests, may constitute a violation of applicable law in both the US and the UK, and will result in account sanctions under Fanvue’s Acceptable Use Policy.
  2. Fanvue will investigate any suspected abuse of this process and may take appropriate action, including permanent removal of access to the Platform and referral to relevant authorities.
