Brazil - PIX Payment Terms

INTRODUCTION

These Brazil PIX Payment Terms apply when you pay for Paid-for Service(s) on Fanvue from Brazil using PIX. They explain who processes your payment, what Fanvue is and is not responsible for, and what rights you have in relation to a PIX payment.

These Terms are provided so that you are informed clearly and in good time about the matters set out in Article 51 of Resolution BCB No. 277/2022 of the Central Bank of Brazil (as amended, including by Resolution BCB No. 561/2026), which governs the international payment and transfer service known as eFX.

This Policy supplements the General Terms & Conditions and other applicable Fanvue Policies. If there is any conflict between General Terms – Section 3 (Paid for Services) and this Policy, this Policy shall prevail for PIX payments made from Brazil.

All defined terms used herein shall have the meaning assigned in the General Terms & Conditions, unless otherwise stated.

A Portuguese version of this Policy is available at Brasil - Termos de Pagamento via PIX. Where you are a consumer in Brazil, the Portuguese version is the version addressed to you.


DEFINITIONS

eFX Provider” means the international payment facilitator that is authorised to provide the international payment or transfer service (eFX) in the Brazilian foreign exchange market under Resolution BCB No. 277/2022, and which processes your PIX payment. The eFX Provider acting for a given transaction is identified to you at checkout and on your receipt.

PIX” means the instant payment scheme operated by the Central Bank of Brazil.

MED” means the Mecanismo Especial de Devolução (Special Return Mechanism), the procedure established by the Central Bank of Brazil through which a PIX payment may be returned in defined circumstances.

Reais” or “BRL” means the lawful currency of Brazil.


1. WHO PROCESSES YOUR PIX PAYMENT

  1. When you pay by PIX, your payment in Reais is received and processed by the eFX Provider, not by Fanvue. The eFX Provider is authorised to operate in the Brazilian foreign exchange market in accordance with Resolution BCB No. 277/2022.
  2. In relation to your PIX payment, the eFX Provider is responsible for:
    1. receiving your payment in Reais;
    2. carrying out the currency conversion and the cross-border transfer of the corresponding funds; and
    3. making available to you a statement or invoice for the transaction in accordance with Article 52 of Resolution BCB No. 277/2022.
  3. Fanvue does not hold a banking, payment institution, or foreign exchange licence in Brazil. Fanvue does not receive your Reais, does not carry out the currency conversion, and does not perform the cross-border transfer.
  4. For the purposes of the eFX service you are a client of the eFX Provider. The eFX Provider may be required to identify and verify you, and to collect information from you, in order to provide the service.
  5. The eFX Provider’s own terms may be presented to you before you confirm the transaction, in accordance with General Terms – Section 3. Those terms govern the payment service itself.

2. THE NATURE AND CONDITIONS OF THE SERVICE

  1. Fanvue is an online content subscription and digital content platform operated by Shift Holdings Ltd, a company registered in England and Wales with company number 12729677, whose registered office is at 2nd Floor College House, 17 King Edwards Road, Ruislip, London, United Kingdom, HA4 7AE.
  2. Fanvue is the supplier of the Paid-for Service(s) you are purchasing. Fanvue is responsible for the digital content, subscription, or other Paid-for Service(s) supplied to you, in accordance with the General Terms & Conditions and applicable consumer law.
  3. The eFX Provider is responsible for the payment service only. It is not the supplier of the Paid-for Service(s) and is not responsible for their content, quality, availability, or delivery.
  4. When you pay by PIX:
    1. the total amount payable in Reais is shown to you before you confirm the transaction;
    2. that amount in Reais is final. It will not be indexed to a foreign currency and will not be subject to any subsequent conversion; and
    3. the conversion rate applied is the rate applicable on the date of the relevant event, in accordance with Article 54 of Resolution BCB No. 277/2022.
  5. Limits may apply to the value of an individual eFX transaction under Resolution BCB No. 277/2022. Where a limit applies, your payment may be declined if it exceeds that limit.
  6. Splitting a single purchase across multiple transactions in order to remain within a regulatory limit is not permitted.

3. HOW YOU PAY YOUR REAIS

  1. You may only pay your Reais to the eFX Provider from a deposit account or payment account held in your own name at an institution authorised to operate in Brazil, or by boleto on which you are named as the payer.
  2. Payments made on your behalf by a third party are not permitted. If the account from which the PIX payment is made is not held in your name, the payment may be rejected or returned, and Fanvue may be unable to supply or may withdraw the Paid-for Service(s).
  3. Fanvue may decline or reverse a transaction where these requirements are not met, or where we or the eFX Provider are required to do so by law or by the Central Bank of Brazil.

4. YOUR RIGHTS WHERE YOU PAY BY PIX

  1. A PIX payment settles instantly. Once a PIX payment has completed, it cannot be reversed by Fanvue in the way that a card payment can be charged back.
  2. If you believe that a PIX payment was made fraudulently or without your authorisation, you may ask your own payment institution to open the MED procedure, which may allow the funds to be recovered. Your payment institution will tell you how to make that request, what evidence it needs, and the time limit that applies.
  3. The MED is intended for cases of fraud, suspected fraud, and operational failure. It is not a mechanism for cancelling a payment because you have changed your mind, or because you entered an incorrect amount or an incorrect PIX key. Where MED is not available to you, our refund position at General Terms – Section 3 and your statutory rights continue to apply.
  4. The MED sits alongside, and does not replace, your rights under Section 5 of this Policy or under Brazilian consumer law.
  5. You may obtain a statement or invoice for your transaction, showing the date, the parties, the amount in Reais, and any fee charged. This is made available by the eFX Provider, and a receipt for your purchase is issued by Fanvue.

5. YOUR RIGHTS UNDER BRAZILIAN CONSUMER LAW

  1. Nothing in this Policy or in the General Terms & Conditions excludes, limits, or reduces any right you have as a consumer under the Brazilian Consumer Protection Code (Law No. 8,078/1990) or under Decree No. 7,962/2013.
  2. Where any provision of the General Terms & Conditions conflicts with a mandatory right you have under Brazilian consumer law, that mandatory right prevails.

6. ACKNOWLEDGEMENT

  1. By confirming a PIX payment, you accept this Policy and confirm that the disclosures set out in Sections 1, 2, and 4 have been made available to you.
  2. This Policy forms part of the terms you accept when you make a purchase, as described at General Terms – Section 3.
