Creator Terms & Conditions

This agreement (“Creator Terms & Conditions”) forms part of your binding legal agreement with Shift Holdings Ltd (“Fanvue,” “we,” “our,” or “us”) and applies specifically to your use of the Fanvue Platform as a Creator.

These Creator Terms supplement the General Terms & Conditions and apply in addition to all other Fanvue Policies.

All defined terms used herein shall have the meaning assigned in the General Terms & Conditions, unless otherwise stated.

By becoming a Creator, you acknowledge that you have read, understood, and agreed to be bound by these Creator Terms.

DEFINITIONS

“Creator” means a User who has completed Creator onboarding and is authorised to submit Paid-for Services or earn revenue through the Platform.

“Creator Balance” means the total available earnings held in your Fanvue account and eligible for withdrawal.

“Creator Earnings” means your share of revenues earned from Paid-for Services, net of Platform Fees and any applicable deductions.

“Platform Fees” means the percentage of User payments retained by Fanvue to cover service provision and operational costs.

“Referral Program” means the referral and affiliate commission scheme set out in our Referral & Affiliate Program.

“Fanvue Policies” means all documents incorporated by reference into your agreement with Fanvue, including but not limited to the Privacy Policy, Acceptable Use Policy, Content Moderation & Protection Policy, and Community Guidelines.

1. CREATOR ELIGIBILITY AND ONBOARDING

  1. In order to become a Creator, you must complete Fanvue’s onboarding process. This includes but may not be limited to:
    1. Submitting valid identity verification documentation and passing a liveness check;
    2. Providing accurate tax and banking information;
    3. Declaring whether your content contains explicit material;
    4. Agreeing to comply with all applicable Fanvue Policies.
  2. We reserve the right to amend the Fanvue onboarding process in order to comply with relevant regulatory laws and/or best practice.
  3. We reserve the right to request updated documentation or re-verification at any time and/or in accordance with our Age Verification Policy.
  4. If you upload Content featuring another person, you must comply with the Co-Authored Content Policy, including verifying their age and obtaining documented consent for their appearance and use of likeness.

2. CREATOR EARNINGS AND COMMISSION STRUCTURE

  1. Creators are entitled to receive Creator Earnings, which represent a percentage of the gross amount received by Fanvue from Users in respect of your Paid-for Services.
  2. Unless otherwise agreed in writing, the standard Creator Earning Rate is 80% of the gross revenue from Paid-for Services. The remaining 20% is retained by Fanvue as Platform Fees.
  3. Fanvue may, at its discretion, offer a Promotional Earning Rate: a temporary, fixed-period uplift to the standard Creator Earning Rate for new or eligible creators. The specific rate, eligibility, and duration of any Promotional Earning Rate are published on the Platform and may be changed or withdrawn at any time without amendment to these Terms.
  4. Full details of Creator Earnings, any current Promotional Earning Rate, and platform commission are set out in the Creator Earnings & Payout Policy.
  5. You are responsible for determining and paying any taxes associated with your Creator Earnings. We do not provide tax advice and will not be responsible for your tax liabilities.

3. PAYOUTS AND WITHDRAWALS

  1. You may request withdrawal of your Creator Balance at any time, subject to:
    1. A seven (7) day settlement period following the original User transaction;
    2. A minimum withdrawal threshold.
  2. Withdrawals are processed via your nominated payment method and are subject to processing times, compliance checks, and external banking procedures.
  3. We aim to process all valid withdrawal requests within ten (10) Business Days, but delays may occur due to fraud reviews, technical issues, or third-party delays.
  4. Any discrepancies in your Creator Balance must be reported within 30 days. We cannot guarantee retrospective adjustments beyond this period.

4. REFUNDS, CHARGEBACKS, AND DISPUTES

  1. If a User receives a refund or successfully raises a chargeback related to your Paid-for Services, we reserve the right to:
    1. Deduct the disputed amount from your Creator Balance;
    2. Recover it from future payouts if it has already been paid out.
  2. If your account exceeds a 1.5% dispute rate (including chargebacks and refunds) over a 30-day period, we may apply a $50 USD (FIFTY US DOLLARS) administrative fee per dispute thereafter.
  3. This fee reflects the costs associated with fraud mitigation, compliance, and platform integrity. We may waive it at our discretion where genuine efforts are made to address the root cause.
  4. You acknowledge that:
    1. Not all disputes are due to card fraud;
    2. Disputes may arise from misleading content, delivery failures, or off-platform solicitations;
    3. You are responsible for maintaining a positive User experience and minimising avoidable disputes.

5. OFF-PLATFORM TRANSACTIONS

  1. Fanvue is designed exclusively for on-platform transactions. Creators must not:
    1. Accept or request payments from Users outside the Platform;
    2. Promote external payment links or services;
    3. Deliver services or content off-platform in exchange for value.
  2. Breach of this clause is grounds for immediate account suspension, payout withholding, and possible permanent removal from the Platform.

6. REFERRALS AND AFFILIATE COMMISSIONS

  1. Creators may participate in the Referral Program by inviting new Creators to join Fanvue using their unique referral link.
  2. If a referred Creator signs up using your link, you may receive a percentage of their Creator Earnings for a defined referral period.
  3. Referral commissions:
    1. Are paid from Fanvue’s Platform Fees, not deducted from the referred Creator;
    2. Are not subject to Platform Fees or Creator commissions;
    3. Are reversible in cases of fraud, abuse, or refund.
  4. You are responsible for complying with marketing laws and disclosure rules applicable in your region. Full details are set out in the Referral & Affiliate Program.

7. SET-OFF AND WITHHOLDING RIGHTS, AND ACCOUNT MODIFICATION

  1. We may, at any time, without warning or Notice and for as long as is necessary to review the relevant facts, (i) suspend or delete your account; (ii) pause Fan Payments which would have been due during the suspension period; (iii) withhold any part of your Creator Earnings; and/or (iv) suspend, refund, or cancel Fan Payments if:
    1. we think you have or may have seriously or repeatedly breached the Terms of Service;
    2. you attempt, or threaten, to breach the Terms of Service in a way which we think has or could have serious consequences for us or another User;
    3. we suspect that all or any part of the Creator Earnings result from unlawful or fraudulent activity, either by you or by the Fan who made the Fan Payment resulting in the Creator Earnings; and/or
    4. necessary in order to comply with a legal obligation or law enforcement investigation.
  2. If, based on our review of the relevant facts, we determine that a breach of our Terms of Service, or unlawful or fraudulent activity has taken place, we may: (i) delete your account and/or your Content; (ii) treat any part of your Creator Earnings as forfeited; and/or (iii) refund or cancel Fan Payments. We will notify you when we take any such action and will provide a statement of reasons why.
  3. If a lien, levy, or other encumbrance is placed on your Creator Earnings, we may withhold any part of your Creator Earnings and may suspend or cancel Fan Payments. We have no duty to make ongoing payments to your creditor(s) and may withhold Creator Earnings until an encumbrance is removed.
  4. We may suspend or terminate your Creator account:
    1. If you breach these terms or any Fanvue Policy;
    2. If you engage in fraudulent, abusive, or harmful conduct;
    3. If required by law or at our sole discretion to protect the Platform.
  5. You may close your Creator account at any time by submitting a request via our Help Centre. Your account closure will not affect any obligations or liabilities incurred before termination.
  6. Enforcement actions taken as a result of Content Moderation & Protection Policy or Acceptable Use Policy – Section 7 violations may include balance deductions, temporary suspension, or permanent removal.
  7. You may dispute a Creator Earnings forfeiture decision, or account termination/suspension decision by following our Complaints Policy. Appeals must be submitted within six months of action.
  1. These Creator Terms form part of your agreement with Fanvue and should be read alongside the General Terms & Conditions and other applicable policies.
  2. Any rights or remedies not expressly granted here are reserved.
  3. The governing law and jurisdiction clauses are as set out in the General Terms & Conditions.
