Creator Referral & Affiliate Policy

This Policy governs Fanvue’s Creator Referral Scheme and Creator Affiliate Programme. These initiatives enable eligible Creative Users to earn additional income by:

Referring new creators to the Platform; or
Promoting the content and profile of other opted-in creators via trackable affiliate links.

This Policy supplements the Creator Terms of Service, Acceptable Use Policy, and all other applicable Fanvue Policies. In the event of any conflict, the terms of this Policy shall prevail for the specific subject matter it governs.

All defined terms used herein shall have the meaning assigned in the General Terms & Conditions, unless otherwise stated.

1. CREATOR REFERRAL SCHEME

1.1 Overview

The Creator Referral Scheme enables Creative Users to earn a commission from Fanvue by referring new creators to the Platform using their unique referral link.

1.2 Eligibility and Conduct

The Referring User must:
1. Hold an active and verified Creative User account;
2. Not refer themselves or any entity they control, directly or indirectly;
3. Share their unique referral link through lawful, compliant methods.
The use of paid search advertising platforms (e.g. Google Ads) to promote referral links is prohibited unless prior written permission is obtained from Fanvue.
Referral links must be used on the same browser session and device for attribution to be valid.
Referred Creators must not have an existing business or personal relationship with the Referring User that would amount to commercial self-referral.
Fanvue may require supporting information to verify independence between Referring and Referred parties.

1.3 Referral Commission

The Referring User shall receive:
1. 5% of the Fan Payments earned by the Referred Creator for a period of 36 months from the date of their registration;
2. Subject to a maximum of $50,000 USD per referred creator.
Commission applies to gross Fan Payments before Platform Fees and applicable deductions.
Any refunds or chargebacks applied to the Referred Creator’s transactions will result in corresponding deductions from the Referring User’s commission.
Referral commissions are credited to the Referring User’s Creative User Balance, categorised distinctly as REFERRAL, and are not subject to Platform Fees.
Referral commissions are paid exclusive of VAT. Referring Users are responsible for declaring and paying any applicable taxes on these amounts.

2. CREATOR AFFILIATE PROGRAMME

2.1 Overview

The Creator Affiliate Programme allows Creative Users to promote the profile of another creator via a unique affiliate link and earn commission from qualifying Fan Payments generated by referred users. This is facilitated through the Fanvue affiliate system.

Participation in this programme is optional and operates through public offers created by promoting creators.

2.2 Programme Structure

The process works as follows:
1. A Promoting Creator creates an affiliate offer through the Affiliate Platform;
2. This offer includes a defined commission percentage and terms as set by the Promoting Creator;
3. Any other Creative User may view and accept the offer to begin promoting the Promoting Creator;
4. Offers are public and not individually approved or assigned.
Affiliate links are tracked via unique identifiers issued when an offer is accepted.
Attribution operates as follows:
1. If the referred user is logged out when clicking the affiliate link, attribution is based on a cookie stored on their device.
2. If the user is logged in, attribution is tracked via their Fanvue account and assigned accordingly.
Commission applies to all Fan Payments generated by the referred User on the promoted Creator’s profile, including subscriptions, renewals, and one-time purchases.

2.3 Earnings and Payment

Commission is:
1. Paid out of the Promoted Creator’s earnings;
2. Calculated on the full value of qualifying Fan Payments;
3. Credited to the Affiliate Creator’s Creative User Balance;
4. Categorised distinctly as AFFILIATION;
5. Settled after the standard 7-day pending period, set out in Creator Earnings & Payouts Policy.
Affiliate commissions are not subject to Platform Fees.
At this time, promoted creators cannot disable or remove individual affiliate links once an offer has been accepted, although this functionality may be introduced in future updates.

2.4 Promotion Standards

Affiliates may promote using any lawful traffic source, provided that:
1. All advertising content complies with relevant laws, advertising codes, and third-party platform rules;
2. Adequate disclosure of the commercial relationship is included (e.g. #ad, sponsored, or similar tags);
3. Promotions must not:
  - Mislead or impersonate Fanvue or the Promoted Creator;
  - Engage in spam, click fraud, or automated bot traffic;
  - Violate Fanvue’s Acceptable Use Policy.
Fanvue reserves the right to suspend or disqualify any affiliate activity that poses a risk to Platform integrity or violates this Policy.

3. ENFORCEMENT, TERMINATION & AMENDMENTS

Fanvue may suspend, withhold, or terminate participation in the Referral Scheme or Affiliate Programme if:
1. The User breaches any applicable Policy or law;
2. There is suspected fraud, impersonation, or self-dealing;
3. Platform integrity or user safety is compromised.
Participation in either programme does not establish any agency, partnership, or employment relationship between Fanvue and the Creative User.
Fanvue reserves the right to:
1. Modify or discontinue the Referral Scheme or Affiliate Programme at any time;
2. Amend this Policy periodically. Updates will be posted at legal.fanvue.com, and significant changes will be communicated when required.
