Agency Terms & Conditions

This Policy sets out the core requirements for operating an Agency Account on Fanvue. It governs access, eligibility, and Platform-level responsibilities. This Policy applies to all agencies that represent Creators or use Fanvue’s agency management features, including but not limited to payment capabilities, account delegation, and content operations.

This Policy is supplemented by the General Terms & Conditions, Creator Terms of Service, and other Fanvue Policies.


DEFINITIONS

  1. “Agency” means an organisation that manages, operates, or provides services to one or more Creative Users through a Fanvue Agency Account.
  2. “Agency Account” means a Fanvue account designated for managing multiple Creative User accounts using approved Fanvue agency tools.
  3. “Creator” means a Creative User on the Fanvue Platform as defined in the General Terms & Conditions.
  4. “Team Member” means any individual granted sub-account access by an Agency to perform tasks on behalf of a Creative User.
  5. “KYB” means Know Your Business verification, including incorporation, shareholder due diligence, and identity documentation required by Fanvue.
  6. “KYC” means Know Your Customer verification, including identity and liveness checks.
  7. “Payment Split” means the Platform-supported allocation of a portion of a Creative User’s earnings to a verified Agency through Fanvue’s native systems.
  8. “Fan” means a user who purchases access to a Creative User’s content.

1. ELIGIBILITY AND VERIFICATION

1.1 Onboarding Requirements

  1. To register as an Agency, the applicant must:
    1. Complete KYC verification for all account operators;
    2. Submit KYB documentation when requested;
    3. Be approved by Fanvue for Agency access and use of native agency tools.
  2. Agencies must disclose:
    1. Registered business status and incorporation details;
    2. Shareholders and ownership structures;
    3. Primary account operators and compliance contact(s).
  3. Record-Keeping
    1. Agencies must retain:
      1. Creator onboarding records and signed agreements;
      2. Team Member contracts and access agreements;
      3. Operational SOPs relevant to Creator account conduct.
    2. These documents must be made available to Fanvue upon reasonable request during onboarding reviews or investigations.

1.2 Verified Agencies and Access Tiers

  1. Agencies that complete KYB may be granted Verified Agency status and access to:
    1. Multi-creator dashboard functionality;
    2. Native account switching and team member assignment;
    3. Payment Splits, as outlined in the Agency Earnings & Payouts Policy.
  2. Agencies that do not complete KYB:
    1. May manage accounts only in a non-financial capacity;
    2. Will not receive direct earnings through Fanvue;
    3. Must manage all revenue-sharing privately and off-platform.

2. CREATOR RELATIONSHIP STRUCTURE

  1. A Creator may only be assigned to one Agency at a time.
  2. Agencies may manage multiple Creator accounts through their Agency dashboard.
  3. Team Members may be assigned to specific Creator accounts by the Agency via Fanvue permissions.
  4. All parties must comply with the obligations outlined in the Agency–Talent Agreement.

3. AGENCY RESPONSIBILITIES

3.1 Operational Conduct

  1. Agencies are responsible for:
    1. Ensuring Team Members uphold the standards outlined in the Agency Conduct & Compliance Policy;
    2. Maintaining transparency and professionalism in communications with fans;
    3. Not misrepresenting themselves as the Creator, even when operating on their behalf.
  2. Agencies acting on behalf of a Creator must:
    1. Protect the Creator’s brand and user experience;
    2. Maintain Platform trust and safety;
    3. Refrain from harmful or exploitative practices.

3.2 Accountability

  1. Agencies are liable for:
    1. The actions of their assigned Team Members;
    2. Any policy violations or misconduct arising from agency-led activity;
    3. Cooperating with Fanvue in disputes, audits, or Platform investigations.

3.3 Ongoing Review and Performance Monitoring

  1. Fanvue may review an Agency’s activity based on:
    1. Creator retention and feedback;
    2. Response times and support ticket escalations;
    3. Fan complaints and moderation interventions.
  2. Verified Agency status may be revoked if standards decline, even without specific policy violations.
  1. Agencies do not receive any intellectual property licence or commercial rights from:
    1. Fanvue; or
    2. The Creator.
  2. The standard Platform licence model remains:
    1. Creators grant a distribution licence to Fanvue;
    2. Fanvue grants a viewing licence to the user;
    3. Agencies act only in a service capacity and hold no licensing rights or ownership.
  3. Earnings Transparency
    1. Agencies may only receive earnings through Payment Splits.
    2. Agencies may not:
      1. Redirect Creator payouts off-platform;
      2. Request direct changes to Creator withdrawal methods;
      3. Circumvent Fanvue’s financial infrastructure in any way.

5. ENFORCEMENT AND TERMINATION

5.1 Platform-Level Enforcement

Offence Classification

To ensure transparency, Fanvue classifies agency violations into two categories:

  1. Minor Offences – May result in a formal strike under the three-strike policy. These include:

    1. Repeated administrative or content tagging errors;
    2. Misuse of Creator messaging features without malicious intent;
    3. Failure to update KYB/KYC records in a timely manner;
    4. Low-quality user engagement or repeated fan complaints without evidence of abuse;
    5. Isolated failure to follow Platform processes or dashboard instructions.
  2. Major Offences – May result in immediate suspension or permanent removal without warning. These include:

    1. Fraud, chargeback manipulation, or data falsification;
    2. Abuse, harassment, or impersonation of Fanvue staff or users;
    3. Accessing Creator accounts without permission or outside approved workflows;
    4. Uploading prohibited or illegal content (see Acceptable Use Policy);
    5. Attempting to mislead users about Creator identity or presence.

Fanvue retains full discretion in classifying behaviour, and reserves the right to escalate a minor offence to a major one if the context or pattern warrants.

  1. Fanvue may suspend, restrict, or terminate an Agency Account for:
    1. Breaches of this Policy or any other applicable Fanvue policy;
    2. Verified misconduct by Team Members;
    3. Repeated operational failures, user harm, or brand damage;
    4. Violations of General Terms – Section 16 (Termination).
  2. Agencies operate under a three-strike policy for minor offences:
    1. Each confirmed violation will result in a formal strike.
    2. Upon receiving a third strike, the Agency will be permanently removed from the Platform and barred from managing any Creator accounts — whether through Fanvue’s native agency functionality or via unofficial access.
    3. Strikes are issued at Fanvue’s discretion and may not be appealed except in cases of factual error.
  3. Termination may result in:
    1. Immediate revocation of Verified Agency status;
    2. Suspension of access to all Creator accounts;
    3. Forfeiture of unpaid balances in accordance with the Agency Earnings & Payouts Policy.

5.2 Unofficial Account Access

  1. Where an agency or individual operates a Creator’s account without using Fanvue’s official agency tools (i.e. by logging into the Creator’s personal account):
    1. The Creator is deemed responsible for all actions taken;
    2. Fanvue considers the Creator the legal account operator for enforcement purposes;
    3. Any penalties or restrictions will apply to the Creator’s account, not the unofficial agency.
  2. Fanvue reserves the right to investigate and, where appropriate, request evidence of unauthorised account access in order to enforce this provision.

6. RELATIONSHIP TERMINATION & ACCESS REMOVAL

6.1 Creator–Agency Termination

  1. Creators may terminate their relationship with an Agency at any time, with or without cause.
  2. The process for doing so, and any applicable notice periods or obligations, are set out in the Agency–Talent Agreement.
  3. Upon termination:
    1. The Creator’s account will be disassociated from the Agency dashboard;
    2. All Team Member access assigned to that Creator will be revoked;
    3. The Agency will cease to have visibility or operational control over the Creator’s account or earnings.

6.2 Agency–Team Member Termination

  1. Agencies may terminate or revoke access from any Team Member at their discretion at any time.
  2. Team Members can be removed from the Agency dashboard or unassigned from specific Creator accounts via the Platform’s sub-account management tools.
  3. Agencies must ensure prompt removal of access in cases of:
    1. Misconduct or breach of Fanvue policies;
    2. Contractual breakdowns or operational risk;
    3. Operational reassignment or internal staff changes.
  4. Fanvue may audit or suspend Team Member access where necessary to protect Platform integrity or upon receipt of a valid complaint.

6.3 Dispute Escalation and Mediation

  1. Where a dispute arises between a Creator and an Agency relating to account operations, earnings, or performance:
    1. Fanvue may, at its discretion, review Platform-level activity logs to assist in resolution;
    2. Fanvue’s role is limited to mediation and technical support — not legal enforcement of off-platform agreements;
    3. Fanvue will only intervene in disputes where Platform tools, balances, or terms have been violated.
