Agency–Talent Agreement
Updated: 16th April 2025
This Agreement outlines the responsibilities, expectations, and platform relationship between a Creative User and an Agency managing that user’s account on Fanvue through native agency functionality. It applies to all Creative Users who engage an Agency to act on their behalf through the Fanvue platform.
This Agreement supplements the Creator Terms & Conditions, Agency Terms & Conditions, and other Fanvue Policies. In the event of conflict, this Agreement shall prevail only for the specific relationship between the Creative User and the assigned Agency.
DEFINITIONS
- “Agency” means a Fanvue-registered organisation authorised to manage Creative User accounts using Fanvue’s agency functionality.
- “Team Member” means a person assigned by the Agency to operate aspects of the Creative User’s account.
- “Agency Functionality” means Fanvue’s native system for assigning, managing, and overseeing multi-user Creator accounts through a centralised Agency dashboard.
1. PLATFORM RELATIONSHIP
- The Creative User agrees to:
- Be represented operationally by the assigned Agency via Fanvue’s platform tools;
- Allow the Agency to manage messaging, content uploads, pricing, and operational duties on their behalf;
- Grant sub-account permissions to Agency-assigned Team Members under the Creator’s discretion.
- The Agency agrees to:
- Operate transparently, honourably, and in accordance with all Fanvue policies;
- Maintain the Creator’s reputation and deliver a professional experience to Fans;
- Only access the Creator’s account using Fanvue-approved agency functionality and not via direct login.
2. CREATOR RIGHTS
- The Creative User retains full rights over:
- Their account and content;
- Their personal brand and public image;
- Approval or rejection of any assigned Agency or Team Member.
- The Creative User may:
- Terminate the Agency relationship at any time by removing the association via Fanvue’s agency interface or by submitting a support request;
- Request a review of the Agency’s activity on their account, where supported by Fanvue.
3. AGENCY RESPONSIBILITIES
- The Agency is responsible for:
- Assigning trained and compliant Team Members to the Creative User’s account;
- Ensuring that all account actions taken by Team Members comply with the Acceptable Use Policy and Community Guidelines;
- Maintaining a standard of communication with Fans that reflects positively on the Creative User.
- The Agency must not:
- Impersonate the Creative User in a misleading way;
- Use off-platform communication methods to bypass Fanvue’s platform or facilitate third-party earnings;
- Prevent or obstruct the Creative User from accessing or controlling their account.
4. PAYMENT SPLITS AND EARNINGS
- If Payment Splits are enabled:
- The Creative User authorises Fanvue to allocate a percentage of their earnings directly to the Agency in accordance with the Agency Earnings & Payouts Policy;
- The Agency must complete full KYB verification to access the split functionality;
- Both parties acknowledge that Fanvue is not responsible for any revenue-sharing agreement made outside of the Platform.
- Fanvue is not a party to any financial or service agreement between the Creative User and Agency beyond the platform-level configuration of Payment Splits.
5. TERMINATION
- The Creative User may terminate this Agreement at any time by:
- Disconnecting the Agency via the platform;
- Notifying Fanvue support.
- Upon termination:
- The Agency will lose access to the Creative User’s account and data;
- Payment Splits will cease, and the Creator will retain 100% of their earnings;
- Any unresolved disputes may be mediated by Fanvue but are ultimately the responsibility of the Creator and Agency.
- Fanvue reserves the right to forcibly disassociate an Agency from a Creative User’s account in cases of:
- Policy breaches;
- Misuse of the account;
- Verified Creator complaints.
7. DISPUTES AND SUPPORT
- In the event of a disagreement between the Creative User and Agency:
- Fanvue may assist in reviewing platform activity and communication logs to support dispute resolution;
- Fanvue is not a legal arbitrator and shall not enforce private commercial agreements outside the scope of its platform tools.
- Creators and Agencies are encouraged to maintain a clear written agreement outside of Fanvue governing revenue splits, performance expectations, and termination conditions.
