Checkout Links Buyer Terms

INTRODUCTION
These Buyer Terms govern all purchases made through Fanvue Checkout Links: shareable, Fanvue-hosted checkout pages (for example fanvue.com/checkout/[id]) through which approved Sellers offer digital products and services. By completing a purchase through a Checkout Link, you agree to these Buyer Terms.
This Policy supplements the General Terms & Conditions and other applicable Fanvue Policies. If there is any conflict between this Policy and the General Terms, the terms of this Policy shall prevail for purchases made through Checkout Links.
All defined terms used herein shall have the meaning assigned in the General Terms & Conditions, unless otherwise stated.
DEFINITIONS
“Checkout Link” means a Fanvue-hosted checkout page through which a Seller offers a Product for purchase.
“Product” means the digital product, service, content, or subscription offered by a Seller through a Checkout Link.
“Seller” means the person or business approved by Fanvue to offer Products through Checkout Links, identified on the checkout page and your receipt.
“Buyer” (or “you”) means the person purchasing a Product through a Checkout Link.
“Merchant of Record” means the entity legally responsible for processing your payment, as described in Section 1.
1. WHO YOU ARE BUYING FROM
- When you purchase through a Checkout Link, Fanvue acts as the Merchant of Record for the transaction. This means Fanvue processes your payment, is the responsible party for the payment transaction, and is the entity that will appear in connection with the charge on your payment statement.
- The Seller is the supplier of the Product. Delivery of the Product, and responsibility for its content, quality, and accuracy, is delegated to and rests with the Seller. The Seller is identified on the checkout page and on your receipt.
- In practice this means:
- For questions about your payment, billing, or subscription management, contact Fanvue.
- For questions about the Product itself (including access, content, or delivery), contact the Seller first using the contact details provided by the Seller. Most Product issues are resolved fastest this way, and if you contact Fanvue about a Product issue our first step will usually be to direct you to the Seller.
- If the Seller does not resolve a Product issue within a reasonable time, you can escalate it to Fanvue. We will review it in accordance with these Buyer Terms and our Complaints Policy and, as Merchant of Record, we are ultimately responsible for resolving it: we may determine the outcome, including any remedy under Section 6, and our determination will be final, subject to your statutory rights.
- Charges will appear on your payment statement with a Fanvue descriptor (for example
FANVUE.COM/PAY/[reference]). The reference links to a transaction details page showing what you purchased and from which Seller. Your receipt is sent by Fanvue and names the Seller.
2. YOUR ACCOUNT
- A Fanvue account is required to complete a purchase through a Checkout Link, but you do not need to have one before you start. If you check out as a guest, an account is created for you automatically at the point of purchase using the email address you enter at checkout, so that you can access your receipts, manage any subscriptions, and view your purchase history. At checkout, before you pay, you will be asked to confirm that you are at least 18 years old and that you accept these Buyer Terms; this confirmation happens at the same time as your account is created.
- When you first purchase from a Seller, your Fanvue account will automatically follow that Seller’s Fanvue profile. This is a free connection that links your account to the Seller for your purchase history and any content or updates the Seller makes available. On return visits, we may recognise your existing account (for example via cookies) to speed up checkout; see our Cookie Policy for details.
- You can access your account at any time via a secure login link sent to your email address. Your purchases are visible in your Fanvue transaction overview.
- Your account and personal data are handled in accordance with our Privacy Policy.
3. PAYMENTS
- The price, currency, and any applicable taxes are displayed on the checkout page before you pay. The total shown at checkout is the amount you will be charged.
- By submitting a payment, you authorise Fanvue and its payment service providers to charge your chosen payment method for the displayed amount, including, where you purchase a subscription, recurring charges as described in Section 4.
- Where you save a payment method, you authorise its secure storage and its use for future purchases and recurring charges you authorise. Our payment providers may use card account updater services to keep stored card details current.
- Additional payment options (such as digital wallets or instalment providers) may be available at checkout. Instalment options are provided by third parties subject to their own terms, which will be presented to you before you commit.
4. SUBSCRIPTIONS
- Where a Product is sold as a subscription, you will be charged the displayed amount at the displayed interval until you cancel.
- You may cancel a subscription at any time through your Fanvue account settings or by contacting Fanvue support. Cancellation takes effect at the end of the current billing period, and you will not be charged further. Amounts already charged are handled in accordance with Section 6.
- If a recurring charge fails, we may retry the charge in accordance with card scheme rules. Continued payment failure may result in the Seller suspending or ending your access to the Product.
- If the price or billing interval of your subscription changes, the change will not be applied without your agreement: you will be notified, and either your subscription will be cancelled before the change takes effect or you will be asked to re-confirm your subscription on the new terms. You will never be charged a changed amount you have not agreed to.
5. DELIVERY OF PRODUCTS
- The Seller is responsible for delivering the Product as described on the checkout page, including granting access to any content, course, community, software, or service purchased.
- Fanvue does not create, own, host, or endorse Products sold through Checkout Links, and does not guarantee any outcome, result, or earnings a Seller may describe or imply.
- The access period, duration, and delivery mechanism for each Product should be described on the checkout page. If a Product is not delivered as described, contact the Seller first, and escalate to Fanvue if unresolved.
6. REFUNDS AND YOUR RIGHT OF WITHDRAWAL
- Products sold through Checkout Links are digital products and services. Unless this Section 6 or your statutory rights say otherwise, purchases of digital content that is available to you straight away are final and non-refundable once you have started receiving it with your agreement. Outside your statutory rights, Fanvue may still choose to give a goodwill refund.
- If you believe a Product was not delivered, was materially not as described, or that a transaction was unauthorised, contact Fanvue support via support@fanvue.com with the details and we will review your case.
- Right of withdrawal: digital content (UK and EU consumers). Where you are a consumer in the United Kingdom or European Union, you may have a statutory 14-day right to withdraw from a purchase of digital content. By purchasing digital content that is made available to you immediately, you expressly consent to immediate supply and acknowledge that you lose your right of withdrawal once supply has begun. This acknowledgement is presented to you at checkout before you pay, and we will confirm your consent and acknowledgement in the receipt we send you.
- Right of withdrawal: services (UK and EU consumers). If you bought a service that is delivered over time (for example coaching, a community, or a course delivered over a period), you can change your mind within 14 days of purchase. If the service already started at your request, you only pay for the part you received before you withdrew, and we will refund the rest. You lose this right only once the service has been fully delivered, where you gave your prior express consent and acknowledgement.
- Nothing in this Policy affects statutory rights that cannot be excluded or limited under applicable law.
7. CHARGEBACKS AND PAYMENT DISPUTES
- If you have a problem with a charge, contact Fanvue support before raising a dispute with your bank or card issuer. Most issues can be resolved faster this way.
- As Merchant of Record, Fanvue handles payment disputes and chargebacks for Checkout Link transactions, and will work with the Seller to gather evidence of purchase and delivery.
- Raising a chargeback or payment dispute without merit (for example, disputing a charge for a Product you received and accessed) may result in the restriction, suspension, or termination of your account and your ability to make future purchases, in line with General Terms – Section 16. Nothing in these Buyer Terms limits your right under applicable law or card network rules to dispute a charge with your bank or card issuer.
8. ACCEPTABLE USE
- You must not use Checkout Links to make purchases with payment methods you are not authorised to use, to launder funds, to test stolen card details, or for any unlawful purpose.
- Your use of Fanvue, including Checkout Links, remains subject to the Acceptable Use Policy.
9. LIABILITY
- Fanvue is responsible for processing your payment as Merchant of Record. The Seller is responsible for the Product, including its content, accuracy, legality, quality, and delivery.
- To the fullest extent permitted by law, Fanvue is not liable for the acts or omissions of Sellers, or for any loss arising from your use of, or reliance on, a Product. The limitations in General Terms – Section 14 apply to these Buyer Terms.
- Nothing in this Policy excludes or limits liability that cannot be excluded or limited under applicable law.
10. COMPLAINTS
- Complaints about a payment, a Seller, or a Product can be raised with Fanvue in accordance with our Complaints Policy.
- Where a complaint indicates that a Seller has breached the Seller Terms or the Prohibited & Restricted Products Policy, we may take enforcement action against the Seller, including removing Products or terminating the Seller’s access to Checkout Links.

Fanvue reserves the right to amend this Policy from time to time. The latest version will always be accessible at legal.fanvue.com, and significant changes will be communicated where required.
