Referral Policy for Fanvue

At Fanvue, we believe that our users are the driving force behind our success. That’s why we have created a referral program that rewards users for sharing their love of Fanvue with their friends and followers. We want to ensure that our users are able to earn additional income through our referral program fairly and transparently. In compliance with regulation 3 of the Trading Scheme Regulations 1997 (as amended) and section 120(1) of the Fair Trading Act 1973, please read the warning below in respect of the Fanvue Referral Program:

• It is illegal for us or a participant in the Fanvue Referral Program (including Referring Users and Referred Creators) to persuade anyone to pay by promising benefits from getting others to join the Fanvue Referral Program.
• Do not be misled by claims that high earnings are easily achieved from participation in the Fanvue Referral Program.
• Although we do not demand any payment from Referring Users to participate in the Fanvue Referral Program, we are legally required to inform you that if you agree to this contract by using our website, you have 14 days to cancel and get your money back.

Introduction

Our referral program is designed to reward Referring Users for referring new users who become platform creators. This referral program is subject to specific rules and regulations, which are detailed below.

Interpretation

To ensure clarity, the following definitions will apply to this policy:

• “Shift Holdings Ltd (Fanvue)” refers to the company that owns and operates Fanvue.
• ”Referring User” refers to any user who refers other users to Fanvue through the Fanvue Referral Program.
• ”Referred Creator” refers to any user who is referred to Fanvue through the Fanvue Referral Program.
• ”Referral Program” refers to the Fanvue Referral Program.

What is the Fanvue Referral Program?

The Fanvue Referral Program allows Referring Users to refer Referred Creators to Fanvue and earn a commission on the referred user’s earnings. The program allows our users to earn additional income by sharing Fanvue with their friends and followers.

The Rules of the Fanvue Referral Program

To ensure the integrity of the Fanvue Referral Program, the following rules apply:

1. Referring Users may not abuse the referral system by self-referring or referring an account owned by the same individual. Doing so will result in immediate disqualification from the referral program and possible account suspension.
2. Only Fanvue users with an active account can participate in the Fanvue Referral Program. Suppose a user’s account has been suspended or terminated by us for any reason or deleted by the user. In that case, they will not be eligible to participate in the Fanvue Referral Program.
3. Each user has a unique referral link, which can be accessed via their account. The user may share this link with others but must not impersonate Fanvue or give the impression that the referral link is being shared or promoted by Fanvue. Additionally, users must not use Google Ads or any similar advertising platform or search engine advertising service to share or promote their referral link. If requested, the user must disclose how they share their referral link.
4. The Referring User is responsible for ensuring that the Referred Creator uses the referral program correctly for the Referring User to benefit from the commission. Fanvue is not responsible for the actions of the Referred Creator. To qualify for a referral payment, the Referred Creator must click on your unique referral link and then register with Fanvue using the same browser that was used to click on your unique referral link. If someone registers with Fanvue without using your unique referral link, we will not link that account to your referral, and you will not receive any referral payments.
5. We will not make any referral payments to you for referring a Referred Creator that we determine is owned or operated by you or has a commercial relationship with you. If we request it, you will provide information to help us determine whether the Referred Creator is owned or operated by you or has a commercial relationship with you.
6. We may withhold referral payments if we suspect any fraudulent activity or breach of our terms of service by the Referring User or Referred Creator.

We reserve the right to modify, suspend or terminate the Fanvue Referral Program at any time without prior notice. We also reserve the right to disqualify any Referring User or Referred Creator who violates our terms of service or engages in fraudulent activity.

Referral Payments, Earnings, and Tax

1. Once a Referred Creator has become a registered User of Fanvue in accordance with the rules of the Fanvue Referral Program described above, the Referring User will be paid a referral payment equal to five per cent (5%) of Fan Payments generated by the Referred Creator in the 36 months after the date on which the Referred Creator becomes a registered User of Fanvue, up to a maximum referral payment by Fanvue to the Referring User of $50,000 USD (Fifty Thousand US Dollars) per Referred Creator. Suppose the Referred Creator generates Fan Payments with a total value of less than US $1 million in the 36 months after the date on which that Referred Creator becomes a registered User of Fanvue. In that case, the Referring User will be paid five per cent (5%) of the Fan Payments generated by that Referred Creator in the 36 months after the date on which the Referred Creator becomes a registered User of Fanvue, following which no further referral payments will be made to the Referring User in respect of that Referred Creator.
2. Any refunds or chargebacks which arise against the initial transaction to the Referred Creator will result in the Referring User’s referral commission being reversed and paid back to Shift Holdings Ltd (Fanvue).
3. The Fanvue Referral Program is free for Referred Creators. Fanvue covers all costs, so you can participate without financial burden. The program rewards your hard work, and Fanvue is committed to fairness and transparency.
4. Earnings generated on Fanvue via the Fanvue Referral Program are not subject to Platform Fees and will be credited to the Referring User’s balance as “REFERRAL”.
5. VAT: If you are a Referring User, you should know that all referral payments payable to you by Shift Holdings Ltd (Fanvue) will be exclusive of any VAT.
